Terms of Service

Plain-English summary:

By using Memoria you agree to these Terms. Subscriptions auto-renew through Apple. You can cancel anytime in iOS Settings. We provide the service as-is and aren't responsible for damaged photos or unsatisfactory restorations beyond the value of your subscription. Use the App for your own personal photos only.

1. Acceptance of Terms

By downloading, installing, or using the Memoria iOS application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of the Service

Memoria is an iOS application that uses third-party AI models to restore old or damaged photographs you choose to upload. Free users can restore one photo at a time. Premium subscribers can restore multiple photos at once and access additional features.

3. Subscriptions and Auto-Renewal

The App offers auto-renewing subscriptions purchased through your Apple ID:

Prices may vary by region and are displayed in your local currency at the time of purchase. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the current subscription.

4. Free Trial

If you start the 3-day free trial, you will not be charged during the trial. After the trial ends your subscription will automatically convert to a paid subscription at the price stated at signup, unless you cancel at least 24 hours before the trial ends.

5. Cancellation and Refunds

You can cancel your subscription at any time in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period. Unused portions of a paid period are not refunded except where required by law.

All refund requests are handled by Apple. You can request a refund at reportaproblem.apple.com.

6. Acceptable Use

You agree to use the App only for restoring photographs you own or have permission to use. You will not:

7. Intellectual Property

You retain all rights to the photographs you upload and to the restored output. We claim no ownership over your content. The App itself, including its design, source code, trademarks, and any associated content, remains our property and is protected by applicable intellectual-property laws.

8. AI Output Disclaimer

Restoration results are produced by machine-learning models that infer details that may not have been present in the original. Output may contain artifacts, alter facial features, or otherwise differ from the original. Memoria makes no guarantee that any specific photograph will be restored to your satisfaction. We recommend keeping a backup of the original.

9. As-Is, Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Memoria's total cumulative liability arising from or related to the App is limited to the amount you paid Memoria in the twelve months preceding the claim, or $50, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, even if advised of the possibility of such damages.

11. Apple-Specific Provisions

You acknowledge that these Terms are between you and Memoria, not Apple, and Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any) for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

12. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms. Sections 7 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), and 13 (Governing Law) survive termination.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Memoria is established, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction, except where local consumer law gives you a right to bring suit elsewhere.

14. Changes to these Terms

We may modify these Terms from time to time. We will revise the "Last updated" date and, for material changes, notify you within the App. Continued use after the change constitutes acceptance.
